So, picture this: you’re cruising on your motorcycle, maybe a little fast, maybe not. Suddenly, a dude in street clothes jumps out, gun drawn, yelling, “On the ground, or I will shoot you!” No badge, no lights, just pure chaos.
That “dude” was Manheim Township Police Chief Duane Fisher, off-duty and apparently off his rocker. The biker? 24-year-old Benny Peña-Rivera, who thought he was about to be robbed or worse.
Caught on camera, Fisher approaches Peña-Rivera with his gun out, pins him against a wall, and keeps the weapon pointed at him. Peña-Rivera, understandably freaked out, manages to break free and runs for his life.
Later, Peña-Rivera claims Fisher didn’t identify himself as a cop until after the scuffle. Fisher says he did. The video? No sound, so it’s a he-said, he-said situation.
The next day, Peña-Rivera gets arrested at a gas station after someone overhears him talking about the incident. Initially charged with a laundry list of offenses, most charges are dropped, and he pleads guilty to some traffic violations.
Fisher? Placed on paid administrative leave. The DA says he followed protocol and won’t investigate further. The township, however, has launched an independent investigation.
Peña-Rivera plans to sue, and honestly, who can blame him?
